Flying can be nerve-racking, even for the most confident travelers out there. There are so many things that can go wrong and, while the traffic in the air is not as intense as on the roads, there are other hazards to traveling 30,000 feet above ground. If you are faced with an airline accident, you could be looking at serious, life changing injuries.

Airplane Accident Fatalities

Many airplane accidents result in fatality. This is a hard fact to swallow and one of the reasons why most people are a little weary of flying. If you have lost a family member in an airline accident, then you will need some time to comprehend what his means for your future. How will you pay the bills without the regular income? How will you take care of the children without this inheritance? How will you be able to emotionally move on from this accident?

We can help you with insurance claims and uncover the facts behind the accident. You may be able to file a personal injury lawsuit against the airline or against the person responsible for the accident.

Causes of Aviation Injuries

Flying is considered one of the safest modes of transportation and if there is an airline accident, it is usually due to the neglect of someone, such as a pilot or mechanic. At TSR Injury Law Firm, we can help you with all types of airline injuries and accidents which may have resulted due to:

  • DUI and DWI airplane accidents
  • Mechanic defects with the plane

Getting over a serious airline injury is going to take time. You could be looking at years of care and hospitalization, especially if faced with a serious brain or spine injury which are quite common in sudden impact accidents such as airline crashes. Furthermore, you may want to take some time off work to grieve the loss of a loved one or to be with the injured person and make life a little better for them.

All of this can cost money and it is important that you understand what you are entitled to in terms of insurance claims and personal injury lawsuits. At TSR Injury Law Firm, we can assist you with gaining compensation to pay for things like:

  • medical equipment, medications, and a personal nurse;

Compensation Claims For Minnesota Lung Injury Victims

Your lungs play an important role in your life. Without properly functioning lungs you will have trouble breathing. You may suffer from serious brain damage if your lungs are unable to bring air to your brain or you may suffer from a serious heart injury if your lungs are unable to bring air to your heart. Either way, you could be looking at a whole new way of life and the potential for fatality as well.

What Can Cause a Lung Injury?

There are some lung injuries that can occur due to poor living habits, family genes or other problems. Smoking, for example, can often result in serious lung diseases such as cancer. However, in some instances, a lung injury can be the result of the neglect of someone else, such as an unsafe medication or a reckless driver. Lung punctures, for example, can result due to a sudden heavy impact often caused by a car accident. Serious complications with the lungs, such as pulmonary embolism, can happen for a number of different reasons including due to some medications such as Avandia and Yasmin birth control.

You can injure your lungs in many other ways as well. Breathing toxic chemicals, unsafe ventilators and asbestos poisoning can all impact your lungs. You may not find out about the damage until several years after the exposure. Car accidents, boating accidents and near drowning can also cause complications to the lung that may impact the rest of your life.

Lung Injury Assistance

At TSR Injury Law Firm we represent clients across Minnesota suffering the aftermaths of a lung injury. This includes:

  • Indirect and direct lung injuries
  • Injury caused by infection
  • Injury caused by chemicals or ventilation
  • Injury caused by asbestos or other harmful toxins

  • Pulmonary aspiration
  • Ventilator lawsuits
  • Punctured lung
  • Pulmonary embolism
  • Sepsis lung injuries
  • Severe bleeding from an injury
  • Lung injury and car accidents

  • Burns

Living with a lung injury can be stressful. You may have to watch what activities you do or be on medication for the rest of your life. You may have to quit your job and remain at home or in constant care. This is not something that you can now control but you can learn to live with it with the financial assistance of an insurance claim or personal injury lawsuit.

Boy Who Nearly Drowned on Disney Cruise Moved to Minnesota Hospital

A boy who nearly drowned on a Disney Fantasy cruise ship in March has now been moved back home to Minnesota and is being cared for in a Minnesota hospital.

Chase Lykken, 4, has suffered brain damage and was released from the Arnold Palmer hospital for children and transferred to Children’s in St. Paul.

The youngest of three, the young boy had just boarded the cruise ship with his family on March 30 in Port Canaveral for a cruise to the Western Caribbean when he was suddenly pulled from one of the three pools on the ship, according to witnesses.

One person stated that he was unconscious and not breathing for a number of minutes. This has resulted in a long and difficult recovery process for the young boy.

After he was recovered from the pool, rescuers performed CPR for Chase to then be transported to Cape Canaveral hospital. He was taken from Cape Canaveral Hospital to Orlando’s Arnold Palmer Hospital.

Port Canaveral Police, who have investigated the incident, would not release specific details, such as how long the boy was under the water. The case is also being investigated by the Florida Department of Children and Families.

Chris and Lisa Lykken, Chase’s parents, have not commented on the incident.

According to information posted online about Chase’s case, he has sustained damage to the parts of the brain that control motor skills and basic function, including body temperature, respiration and heart rates, hunger and thirst, eyesight, and the sleep-wake cycle.

Friends have been organizing to help the family offset medical costs.

One photo of Chase online shows him wearing a Captain America costume. The comic-book hero’s red, white, and blue shield was posted on the Internet on Chase’s caringbridge.org and Facebook pages. So far, the Facebook page has netted over 4,000 likes. The caringbridge.org page has over 2,200 comments of encouragement and good wishes.

PCL Tear Injury Claims in Minnesota

TSR Injury Law puts the personal in personal injury law. We listen to you and your needs. Then, we will tell you your options and help you maneuver the legal system. Steve Terry, Chuck Slane, Rich Ruohonen, and Nate Bjerke have extensive medical knowledge and years of experience handling knee injury cases. Call TSR Injury Law about your posterior cruciate ligament (PCL) tear, at (612) TSR-TIME or submit our free consultation form.

There are four primary ligaments that hold the knee joint together and give the knee stability and flexibility. The PCL is located at the back of the knee joint. It keeps the tibia from moving too far back. The PCL is stronger than the ACL; therefore, it is not injured as frequently because it takes more force to tear it.

Grading a PCL Tear Injury

A PCL tear is frequently referred to as a “dashboard injury” because a common cause of a PCL tear is a bent knee hitting a dashboard in a car accident or truck accident. The dashboard forces the shin backward, damaging the PCL and sometimes other ligaments in the knee.

PCL tears are divided into three grades:

  • Grade 1 PCL Tear – the ligament is slightly stretched and mildly damaged, the knee is still stable
  • Grade 2 PCL Tear – the ligament is stretched and loose, is partially torn or completely torn, no other ligament injury, the knee is somewhat unstable
  • Grade 3 PCL Tear – the ligament is split into two pieces (a complete tear), additional ligament injuries, the knee is unstable

Minnesota PCL Tear Treatment

A PCL Tear may be treated non-surgically or surgically, depending on whether there are additional injuries.

The non-surgical options include:

  • The R.I.C.E. regimen of rest, ice, compression, and elevation is helpful immediately after a PCL injury.
  • Bracing may be used to immobilize the knee and protect it from further damage.
  • Physical therapy is recommended once the swelling has subsided. This will strengthen the leg muscles and restore function to the knee.

Surgery is recommended only for a complete PCL tear combined with additional injuries. Arthroscopic surgery is done to rebuild the ligament because the PCL is resistant to healing with suturing. The ligament will be replaced with tissue graft from another part of the body or a donor. A graft can take several months to heal.

Minneapolis Chiropractor Malpractice Attorneys

Chiropractic has been a controversial form of medicine since it first became popular in the U.S. in the late 19th century. Some people claim that the entire field is a scam, while others argue that there are only a few chiropractors who give the rest a bad name. One fact is not in dispute: chiropractors who practice their form of medicine badly, are a danger to their patients. Have you suffered injury from a negligent chiropractor? Are you hurting and angry? Call TSR Injury Law at 612-TSR-TIME or submit our free consultation form.

Types of Chiropractic Error

The Minnesota chiropractor malpractice attorneys of TSR Injury Law are familiar with a variety of chiropractic injury claims. Generally, the errors committed by negligent chiropractors fall into one of two categories:

  • Failure to correctly diagnose a problem. As with other fields, some chiropractors are so devoted to their form of medicine that they believe it can cure any ailment. People have been seriously injured by receiving only chiropractic treatment when their condition actually required a conventional medical doctor.
  • Damage to body parts. Although many chiropractors are committed to their patients’ health and safety, some are less attentive. Patients can be seriously injured by reckless manipulation of their joints, bones, and muscles. Those with weakened or damaged bones or muscles are especially at risk.

Holding Chiropractors Responsible

If you have been injured by a negligent or fraudulent chiropractor, there is a way for you to seek justice. A chiropractic malpractice suit can be filed in the same fashion as any other form of medical malpractice suit. An experienced Minnesota chiropractic injury lawyer will be able to give you more details.

Pilot Killed in Plane Crash

A Bemidji pilot was killed when his plane crashed early in December in Northern Illinois.

Larry Diffley, 74, president of a small charter airline in Minnesota, was killed when his two-engine plane crashed into a Manhattan Township soybean field owned by the family of Ray Nugent. The crash, which occurred just before 3 p.m. on December 4th, left a path of debris that was a few hundred yards long.

It was confirmed that Diffley was the only one in the Hawker Beechcraft BE-58. It was registered with Bemidji Aviation Services, which is based in Minnesota and is a cargo and charter airline that Diffley co-owned for almost four decades before the company became owned by its employees in 2006. Diffley was, however, the company president.

As for where Diffley was heading, the Will County Illinois authorities said that Diffley was working for an oil pipeline company and was going to the Joliet airport to pick up another individual. Diffley almost made it to Joliet when the plane went down.

It was realized that something was wrong when Diffley had not showed up on time and no one had heard from him. It was not long before the call came in that informed those waiting on Diffley that his plane had crashed in the nearby field.

It is suspected that the cause of the crash may have been a fuel issue because there was no gas odor at the scene of the crash, nor was there a fire. The reason for the crash is currently under investigation. If someone that you love has been fatally injured in an incident that may have been caused by the malfunction of a defective product, you may be eligible to file a damages lawsuit. Separated Shoulder Injury Claims in MN

Three bones form the shoulder joint: clavicle, scapula, and humerus. A shoulder separation is a tear in the ligaments holding the scapula and clavicle together.

A shoulder separation happens most often in slip and fall cases, but they can occur in car accidents and truck accidents from bracing against the dash or being forced against the door. Shoulder separations are rated 1, 2, or 3, depending on the distance between the scapula and the clavicle.

  • A grade 1 shoulder separation has tenderness but no actual separation. It involves a sprain of the acromioclavicular (AC) ligament, without displacing the clavicle. The shoulder will look normal on an X-ray.
  • A grade 2 shoulder separation has slight separation of the clavicle from the scapula. The AC ligament will be torn and the coracoclavicular (CC) ligament may sustain minor tears.
  • A grade 3 shoulder separation is when the AC joint is noticeably out of position. The AC and CC ligaments sustain complete tears.

Treatment of Separated Shoulder

The first treatment recommended is immobilization until the pain dissipates. Simple separations do well if the ligaments are not extensively damaged. More serious ligament damage may require surgery. Sometimes surgery is delayed to see if the shoulder will heal and regain full function without surgery.Whether the shoulder separation is treated conservatively or with surgery, the shoulder will require physical therapy to restore range of motion and rebuild strength and flexibility.

Inmate Charged in Beating of Fellow Prisoner Resulting in Severe Injuries

An inmate serving 30 years in prison for the rape of a girl was in court again for severely beating another inmate in a St. Cloud prison back in September.

Leonard James Fisherman Jr., 30, is now facing charges for first-degree assault after a fight left another inmate dealing with very severe injuries. The injuries included bleeding on the brain and a number of facial fractions. The injured inmate also had to have part of his skull removed so that his brain could be operated on.

The fight occurred on September 22 at the St. Cloud-based Minnesota Correctional Facility. The inmate that Fisherman allegedly beat was housed in the cell next to Fisherman and he was throwing things and yelling in his cell while looking for his identification.

Fisherman and fellow inmates were telling the man to be quiet. The victim would eventually leave his cell. This is when he was met face-to-face by Fisherman outside of his cell. Fisherman would then allegedly block the victim to keep him from getting around him and then started to hit the victim repeatedly in the face with a closed fist.

According to the complaint, the victim would fall to the ground, but Fisherman kept hitting him and wouldn’t let him get back on his feet. Fisherman would then continue to kick the victim and stomp his head. Correctional officials said that they had to use chemical spray to stop the attack. As the officers were using the chemical spray, Fisherman was holding on to the victim, but he did let go. This is when the victim fell from the second floor of the housing unit to the main floor.

When officers ran to him, they found the victim bleeding from his head and he was unresponsive. It only took a couple of minutes to have him rushed to a St. Cloud Hospital where it was immediately determined that he needed surgery. While in the ER, doctors reported that the victim’s heart rate had dropped significantly but that medication was able to normalize it.

Fisherman would later be escorted to segregation. During this time, he was reported to be pounding his chest saying “just think, I just killed him.”

Fisherman is in prison after being convicted of raping an underage girl at knife point. He also has past convictions for sex offenses, drugs, and assault that go back to when he was 18 years old.

The victim, who is 20 years old, is serving a one year sentence for a probation violation relating to terroristic threats.

The Bloomington personal injury lawyers of TSR Injury Law believe that you should not have to suffer the consequences of an accident that was not your fault. We have helped thousands of people recover millions in compensation, including a recent settlement of $1.7 million for an accident that included a badly broken ankle.

Why Ankle Fusion May Be Needed

You may have suffered a severe ankle fracture in a car accident or a slip and fall accident. As a result of the fracture, the ankle may have never healed correctly or may have developed arthritis. Ankle fusion may be recommended if:

  • your pain is so great that you are not able to continue working;
  • you are having issues with taking painkillers for an extended time; or
  • your quality of life has deteriorated.

About Ankle Fusion

An ankle fusion removes the articular cartilage from the surface of the ankle joint, which allows the tibia to fuse with the talus. The bones literally grow together. A successful ankle fusion does not wear out like an artificial ankle — it should last a lifetime.

Ankle fusion surgery can be arthroscopic or open. Open ankle fusion takes less time in surgery, but more time to heal. Arthroscopic surgery has a higher percentage of achieving fusion. Because the positioning of the bones is so critical to a successful fusion and your future comfort level, you need to have the surgery performed by a surgeon who has performed many ankle fusions.

Ankle Fusion Complications

There are many complications associated with ankle fusion, including:

  • nerve damage (could result in numbness in the foot);
  • blood vessel damage (could lead to the need for amputation);
  • infection (could require further surgery to drain the infection);
  • nonunion (could require another surgery to perform a bone graft or additional fixation); and
  • malunion (could cause problems with walking and require another surgery to achieve a better position of healing).

Ankle Fusion Recovery

After surgery, a padded plaster cast is required for 8 to 12 weeks. It is vital to refrain from putting any weight on the foot until x-rays show that the bones are fusing.

Physical therapy may be needed to learn to walk smoothly, without a limp. Once the fusion is completely healed, some shoe modifications may be helpful. There are shoe inserts or rocker soles available that allow the foot to roll more normally.
