13-Year-Old Winthrop Boy Dies after Bike Struck by Semi

While there are many bicycle accidents throughout Minnesota, and a number of them involving children, fatalities are not as rare as the severe injuries that can exist.

In this case, a 13-year-old boy from Winthrop died on September 15 after he was struck by a semi while riding his bike on Highway 15, according to the Minnesota State patrol.

Jacob W. Weber was with a group of juveniles that were riding their bikes northbound on the two-lane highway at approximately 2:30 p.m. when Weber suddenly left the shoulder of the road and into the path of a 2007 Mack tractor-trailer. The semi struck the boy.

The Winthrop Fire Department, Sibley County Sheriff’s Office, Winthrop Ambulance, and Life Link all responded to the accident, transporting Weber to Hennepin County Medical Center. His injuries were critical, but he was still alive at the time of transport. He passed away at 11:40 a.m. on the 16th.

The family said that Jacob died doing what he loved to do and they made the decision to donate any organs that could be potentially used in transplants.

Andrew C. Damhof, 23, and the driver of the truck was not injured in the accident. Alcohol was also not a factor in the crash.

Minnesota Pelvic Injury Claims

TSR Injury Law is a powerful personal injury law firm with extensive experience with broken bone injury lawsuits and a reputation for large settlements, including a recent verdict of more than $1.5 million. Our personal injury lawyers are experts at establishing fault in serious motor vehicle accidents. Call (612) TSR-TIME or submit our free consultation form.

The pelvis is a ring-like structure at the base of the spine. It cradles many of the digestive and reproductive organs, as well as being at the crossroads for nerves, blood vessels, and muscles. It is critical to the alignment of the entire skeleton.

Minnesota Pelvic Fracture Injury

The majority of pelvic fractures involve high-impact forces as in motor vehicle accidents or falls from great heights. Pelvic fractures can be life-threatening and require surgery. They can be open or closed and are further classified as:

  • stable – only one break and limited bleeding, the bones are not displaced
  • unstable – two or more breaks, moderate to excessive bleeding, the bones are displaced

A pelvic fracture should be suspected and investigated if there is bone tenderness, difficulty walking, or loss of nerve function in the lower body. Additional symptoms may include:

  • abdominal pain
  • numbness or tingling in the groin or down the legs
  • bleeding from any lower body cavity
  • difficulty urinating

In severe fractures, the victim needs immediate medical attention because of the possibility of shock, extensive internal bleeding, nerve damage, soft tissue damage, and organ damage. The injuries must be stabilized; advanced trauma life support management may be required.

Minnesota Pelvic Fracture Treatment

Pelvic fractures require x-rays to determine the best course of surgery and sometimes a CT scan will be ordered to define the extent of the associated injuries. External fixators may be used to stabilize the pelvic area, allowing surgeons to address the injuries to the nerves, blood vessels, and organs. Unstable fractures may require the insertion of plates or screws.

It takes many months of rehabilitation and physical therapy to recover from a pelvic fracture. There is no guarantee of a full recovery. Long-term complications may include:

  • limp due to damage to musculature
  • pain
  • impaired mobility
  • sexual dysfunction
  • nerve damage
  • issues as a result of any organ damage (e.g. kidney failure, leaking bladder)

New Brighton police and Ramsey County Water Patrol were called around 2:30 p.m., Wednesday afternoon about a possible drowning near a Long Lake beach. A 6-year-old-boy was unresponsive after being rescued from 8’ deep water.

The boy was found, by lifeguards, within minutes of being reported missing. He was given CPR and taken to Gillette Children’s Specialty Healthcare, in St. Paul, and is listed in critical condition. No further information is available at this time.

The boy was on a field trip with a group from Roseville schools. The beach was closed for the rest of the day. Authorities continue to investigate the incident.

Talus Fracture Injury Claims

The talus bone is a pivotal bone in the ankle. It is an important connector between the leg and foot and is held in place by ligaments — no tendons. Most talus fractures occur in car accidents or truck accidents and they are marked by swelling, bruising, severe pain, and inability to bear weight. If a talus fracture goes untreated or does not heal properly, it can create long-term complications. Those complications include:

  • impaired foot function
  • loss of range of motion
  • arthritis
  • chronic pain
  • bone collapse

Talus Fracture Treatment

If a talus fracture is suspected, the doctor will order a series of x-rays of the ankle and foot to pinpoint the location of the fracture. If x-rays are inconclusive, a CT scan will be necessary. The imaging will help the orthopedist determine whether the bones are aligned or displaced. Imaging will also reveal if loose bone chips are present that may need to be removed surgically.

The doctor will check for nerve damage and adequate blood supply to the joint and the foot. If the blood supply is disrupted, the bone tissue could die allowing the bone to collapse. The orthopedist will usually do a follow-up x-ray or MRI to check on the blood supply.

After surgery, the ankle will be immobilized in a cast for 6-8 weeks. The ankle must not bear weight for at least 3 months. Even if the talus fracture heals properly, the ankle may eventually develop arthritis. More than half of the talus is covered with cartilage. When the cartilage is injured, the smooth surface is compromised which can lead to accelerated joint wear and ultimately arthritis.

There are a variety of treatments for arthritis, including:

  • modification of activity
  • ankle-foot brace
  • joint fusion
  • bone grafting
  • ankle replacement

Common Construction Site Injury Causes

Workers within the construction business put trust in the equipment that they use. They trust it to work safely and effectively as stated to them by the manufacturers. If the equipment doesn’t work correctly, then the worker can be placed in a life threatening situation.

If you have been injured while using defective construction equipment, it is your right to collect monetary damages from the parties responsible. Those responsible parties include the manufacturer who produced it, the company who maintained it, the company who sold it to you, and the employer who may have ignored issues with the equipment. With so many responsible parties, you have to have a Minneapolis construction equipment defect lawyer who is experienced and who knows how the equipment manufacturers and other companies involved will defend themselves.

Common types Of Construction Site Accidents

Building collapse, roof accidents, faulty scaffolding, cranes that malfunction, and equipment that simply fails to work as specified are the common types of accidents that occur at construction sites due to defective equipment. Perhaps a piece comes loose or the device works at an improper speed. There are so many defects that can occur because there are so many moving parts to a piece of machinery. Other types of accidents include:

  • Trench collapse
  • Electric shock
  • Forklift defects
  • Lack of protective gear or protective gear malfunction
  • Jackhammer malfunction
  • Backhoe malfunction

Of course, the list can go on and on, depending upon the type of construction site and the equipment that is being used.

More Than Workers’ Compensation

Minnesota usually does not allow the construction worker to sue their employer if workers’ compensation benefits are received. However, a construction worker has a great chance of success because a construction site usually has more than one contractor working on the job. One or more of these contractors could be held liable, depending upon the circumstances surrounding the incident and the liability insurance that is present.

We do understand that having to take legal action after an accident involving a construction equipment defect can be very difficult for you and for your family. Fortunately, you will be working with a Minnesota construction equipment defect lawyer with the resources, training, and experience to handle every detail of your case. It is your right to seek out compensation for lost wages, medical expenses, pain and suffering, loss of enjoyment of life, and emotional distress.

Minneapolis Aviation Accidents Lawyer

An aviation accident is an accident that takes place under unique circumstances. For one, you are 30,000 feet above ground. Secondly, you are usually not the one in control of the airplane, and thus you have little control of what happens. Putting your life in the hands of a professional pilot and an experienced grounds crew can be nerve racking, and many people choose not to fly because of the risks. While flying is considered one of the safest modes of transportation, it can still be scary — especially as if there is an aviation accident. The results of which are often life altering or fatal.

Airplane and Helicopter Accidents

When you hear of a helicopter or airplane accident, it often ends with death. This is because of the sheer impact and strength of these machines, as well as the unique mode of travel where you are usually more than six miles above ground. Airplane accidents can happen for a number of reasons including:

  • mechanical defects with the machine;
  • inadequate servicing and maintenance by the mechanic staff;
  • poor driving and navigating by the pilot;
  • a loss of control over the machine;
  • extreme weather conditions; and
  • airplane and helicopter collisions.

How We Can Help

Whether you have been injured or you are inquiring on behalf of a family member’s serious injury or death, you have the legal right to compensation in almost all instances. We can help you gain the financial compensation to get your life back on track after a serious aviation injury including compensation for:

  • unpaid medical expenses;
  • medical equipment for around the house and in the car;
  • rehabilitation and recovery;
  • therapy sessions for yourself and your family;
  • a loss of income and protected income;
  • a loss of benefits; and
  • a loss of quality of life.

We have helped families gain a better understanding of what happens after a serious aviation accident that results in a life-changing injury or death. Often, if you do survive a plane crash, you will be left with permanent disability and damage to areas such as your spine, brain or limbs. You may be unable to walk ahead; you may need to have constant home care; or you may be unable to work. This impacts more than just the person injured – it impacts their entire family, as well.

Commercial airlines have a legal responsibility to protect their passengers. There are laws in place, such as no alcohol law for pilots, and certain regulations for mechanics and grounds crew. If an airplane is deemed unsafe, under no circumstances should it be able to fly. In the event of an aviation accident, it is often due to utter negligence of the rules and regulations by the commercial airline company.

This is not acceptable. At TSR Injury Law Firm, we offer our tenacity and our experience in airplane crash cases. We are Minneapolis personal injury lawyers that can, and will, help you win your case. Call (612) TSR-TIME for a free initial consultation about your case or submit our free consultation form.

Understanding Product Liability

Product liability is an area of U.S. law under which manufacturers, distributors, suppliers, and retailers can be held responsible and financially accountable for any faulty or defective products they release to the public. This area of the law covers individuals who may be injured by these defective products so that they will not have to pay for their injuries out of their own pockets.

Claims Associated with Product Liability

There are a number of different claims associated with product liability. The most well known are claims of negligence and strict liability.

Each of these claims has different requirements that must be met in order to prove guilt on the part of the manufacturer, seller, distributor, or retailer. Usually, a products liability claim is based on one of the following:

  • A design defect
  • A manufacturing defect
  • A failure to warn consumers (of some danger)

Interestingly, claims (especially based on a failure to warn) can succeed even if the consumer uses the product incorrectly as long as the incorrect usage could have been foreseen by the manufacturer or other party.

Product Liability: Strict Liability vs. Negligence

Most product liability cases are not based on issues of negligence, but rather, on something known as strict liability. To understand the difference between these two, let’s first examine the qualities of negligence.

In order to prove negligence, one must show that:

  • There was some duty owed by the manufacturer (or other party)
  • There was a breach of this duty
  • An injury occurred
  • The injury was directly caused by the breach mentioned above

Thus, a manufacturer or other party who failed to perform their job appropriately will be held responsible for any defective products that resulted from the oversight.

However, as mentioned above, most product liability claims are not based on negligence but on strict liability. What this means is that the manufacturer (or other party) is held responsible for defective or faulty products even if they did not act in a negligent manner. This way, a consumer can recover damages for an injury even if unable to prove that there was a preventable error in the manufacturing process.

Minneapolis Elevator Accident Lawyer

People rely on elevators and escalators whenever they do not want to take the stairs. In some buildings, taking the elevator is really the only option to get to an office or apartment. Elevators, however, do have a history of injuring people. Fortunately for the millions that take elevators on a daily basis, the most commonly injured people are the individuals who are repairing the elevator.

Common causes of injury to passengers include:

  • Not opening level with the floor
  • Getting stuck
  • Sudden increases or decreases in speed
  • Missing the floor of a building
  • Falling or plummeting down the elevator shaft

Of the above causes of injuries, all are fairly rare. Other elevator accidents can be caused by:

  • Poorly positioned elevator floors causing people to trip on an uneven surface
  • Elevator doors opening onto an open shaft
  • Being trapped in a closing door
  • Accessible elevator shafts

These injuries are also uncommon. Despite the rarity of elevator injuries, on a yearly basis, there are 30 fatalities caused by an elevator in some way. In addition to the 30 fatalities, more than 10,000 people are injured on an annual basis.

In an effort to protect individuals, most states and cities have enacted regulations that cover the construction, operation, and maintenance of elevators. However, it is not uncommon for buildings not to comply with the various regulations.

Radiofrequency Neurotomy: The Procedure

Radiofrequency neurotomy is a treatment used to alleviate pain from a facet joint injury, usually incurred in a car accident. Facet joints are situated at each vertebral level of the spine. Each joint is connected to two medial nerves. The medial nerves transmit signals from the spine to the brain and the rest of the body.

  • The doctor, using x-ray guidance, inserts the needle parallel to and against the targeted nerve.
  • An intermittent electrical current is delivered; creating a heat lesion, interrupting the pain signals to the brain. The current cannot be a continuous flow because that could damage the ganglion (nerve bundle) or surrounding tissue.
  • Over the next 10-14 days the nerve dies; hopefully, providing the patient with full pain relief within 2-3 weeks.

Radiofrequency Neurotomy: Potential Complications

Radiofrequency neurotomy is not a cure for your injury; it is a treatment. It is a treatment that is effective for an average of only 11 months. That means you will have to have RFN repeated multiple times during your lifetime.

With all medical procedures, there are risks and potential complications. The associated complications with RFN are:

  • pain at the site of injection
  • numbness at the site of injection
  • increased facet joint pain due to muscle spasms
  • permanent nerve damage
  • infection

Causes of Cerebral Palsy

Cerebral palsy is caused by damaged connections between the cerebral cortex and the cerebellum. In other words, people with this condition have an impaired ability to control their own movements and reflexes.

About 5% of cases of cerebral palsy are caused by birth injuries, with other cases being caused by injuries during pregnancy or after birth. Birth injuries that can cause or contribute to cerebral palsy include:

  • Hypoxia (lack of oxygen to the brain)
  • Premature birth
  • Infection
  • Head trauma or brain hemorrhaging
  • Severe jaundice

Hip Replacement Compensation Claims

TSR Injury Law is a leading personal injury law firm serving Minneapolis and the state of Minnesota. We are passionate about helping injured people find justice. Our partners have years of experience and a history of winning impressive settlements, including a recent $1.5 million verdict for a hip fracture.

Hip replacement surgery following a car accident or motorcycle accident happens all too often. When it does, you need expert legal representation to secure adequate compensation for your potential loss of quality of life. Contact a licensed Minnesota personal injury lawyer by calling (612) TSR-TIME.

Minnesota Hip Replacement

Hip replacement surgery may be recommended if you have suffered severe hip damage. It involves removing the damaged hip joint and replacing it with an artificial one. Statistics show that hip replacements last 15 years in 95% of the cases. Possible scenarios for needing a hip replacement:

  • Car crash victim suffered dislocated left hip and an impacted comminuted fracture of the acetabula and posterior wall of the right hip — after 8 months of rehabilitation, the car crash victim developed sciatic neuropathy of the right leg resulting in drop foot syndrome and needed hip replacement
  • Truck crash victim suffered herniated disc, fractured pelvis, and fractured hip — initially these injuries healed but the victim developed post-traumatic arthritis and required hip replacement
  • Motorcycle crash victim suffered numerous fractures of left hip, including fracture of femoral head, closed reduction surgery was performed — second surgery necessary and screws used to hold large bone fragments in place, but hip could not be stabilized leading to third surgery performed to do hip replacement

Hip Replacement Complications

There can be many complications with a hip replacement. They include:

  • Blood clots in the leg veins can develop due to decreased movement of the leg after surgery or possible injury to the veins during surgery. Blood-thinning medications are normally prescribed to prevent clots from forming. Compression devices or elastic stockings can be used to increase blood flow through the veins in your legs and reduce the risk of clots.
  • Infections can occur at the incision and in the deep tissue near the new hip. Most infections can be treated with antibiotics, but a major infection near the prosthesis may require further surgery to remove and replace the prosthesis.
  • A fracture can happen during surgery to healthy areas of the hip joint.
  • Dislocation of the new hip joint can be an issue. If the artificial hip dislocates repeatedly, surgery may be required to stabilize it.
  • The artificial hip can break, requiring another surgery to replace the broken joint.
  • Change in leg length. The surgeon takes steps to avoid this problem, but occasionally the new hip will make the leg longer or shorter than the other one.
  • Stiff joint, from the soft tissue hardening around the joint and making it difficult to move.
  • The prosthetic hip joint may wear out, requiring a second hip replacement surgery.
