Transit Bus Hits Bicyclist

Most bus accidents tend to involve pedestrians, other vehicles, or a maneuver by the bus driver can cause the bus to overturn, such as taking a corner too quickly. Unfortunately, there are many ways a bus can be involved in an accident and these accidents can sometimes be fatal. In turn, these accidents lead to auto accident lawsuits and much more.

On September 18, Minneapolis police reported that a Metro Valley Transit bus hit a female bicyclist near the University of Minnesota campus in Dinkytown.

The incident occurred at the 10th Avenue South and 4th Street SE intersection at around 4:20 p.m., trapping the woman underneath the bus.

Investigators say that it looks as if both the bicyclist and the bus were westbound on 4th Street SE and ended up side-by-side, which set them up for the accident. The bicyclist was in the bike lane on the left side of the one-way street. They then turned onto the two-way 10th Avenue South at the exact same time. It was during that turn that the two collided, partially trapping the woman under the bus and the bus ran over the bicycle. The woman was later freed and rushed to the Hennepin County Medical Center.

Fortunately, her injuries are not life threatening, so she is expected to survive. The driver of the bus has not been cited in the accident. The identities of the involved individuals have not been released, but it is believed that the bicyclist is a student at the University.

School Bus Accident Statistics

There are millions of children that ride the school bus safely every day, every school year. Although they are the safest vehicles on the road, 8 children died in Minnesota in 2007. The greatest risk is getting on /off the bus. According to the Minnesota Department of Public Safety, in 2007 there were:

  • 680 school bus accidents
  • 7 fatal accidents
  • 8 people killed in those 7 school bus accidents
  • 126 injury accidents involving a school bus
  • 243 people injured in the 126 school bus accidents

School Bus Related Standards and Inspections

In 1971 the Minnesota State Patrol was mandated to perform school bus inspections on every registered school bus in the state. Inspections are performed annually, by seven teams of inspectors. They inspect about 14,000 buses. There are approximately 20,000 endorsed school bus drivers. The drivers are required to have a physical every two years, a criminal background check every four years, and urine and breathalyzer tests are performed at random.

October 21,2008 the National Highway Traffic Safety Administration enacted a final rule requiring lap / shoulder belts for small school buses, effective on all buses (10,000 pounds or less) manufactured after October 21, 2011. They are hoping this will provide optimum protection for the students being transported in a school bus.

Drunk Drivers

Drunk drivers actually put other people on the road in more danger than themselves, making the choice to drive after too many drinks is clearly wrong. Sadly, Driving While Intoxicated (DWI) and Driving Under the Influence (DUI) are both very common occurrences.

In 2006, there were 13,470 fatalities in crashes involving inebriated drivers, composing 32% of the total traffic fatalities for that year. Still more people sustained serious injuries in DWI accidents.

Minnesota Law on Drunk Driving

Minnesota law takes drunk driving very seriously. People who are convicted of DWI face heavy fines, community service, jail time, and suspension or loss of their driver’s licenses. Unfortunately, criminal penalties do little to help those who have already been injured by drunk drivers.

One way for drunk drivers’ victims to win fair compensation is by filing a drunk driving lawsuit. Our Minnesota drunk driver lawyers can help you with:

  • DUI/DWI
  • Dram Shop Laws
  • Social Host Liability

If You’ve Been the Victim of a Drunk Driver

If you or a loved one has been injured by a drunk driver, it is important that you know what your legal options are. Successfully filing a Minnesota personal injury suit against the responsible party can win you compensation for:

  • Past, present, and future medical expenses
  • Wages lost to medical leave or loss of your job
  • Your current physical and emotional suffering

Tragedy has struck again near Hugo on I-35E northbound. The traffic was heavy due to construction. Apparently a 19-year-old driver was inattentive, crashing her Honda Civic into a VW Cabriolet.

The Civic was doing highway speeds and the force of the impact pushed the VW into a Ford pickup truck, which then hit the next vehicle in line, a Chevy Cobalt. The vehicles were strewn across the interstate and off the road.

The 32-year-old driver of the VW was taken to North Memorial Hospital in critical condition. She passed away early Wednesday morning. She was from Hugo. According to the State Patrol, three other people involved in the crash sustained minor injuries.

Interstate 35 northbound was shut down for three hours due to the crash. The accident is under investigation. Alcohol does not seems to be a factor in the crash.

Edina Man Allegedly Hits Cruiser While Drunk

An Edina man is accused of crashing into two State patrol cruisers while he was drunk late in January.

Maurice Blevins, 39, was allegedly driving near the I-25W ramp along I-494 at 10:22 p.m. on a Saturday when he hit the two patrol cars that had just responded to the scene of a rollover crash. According to the complaint, Blevins was charged with negligent operation of a motor vehicle and gross misdemeanor driving DWI. Blevins is also facing a charge of driving with a license that was revoked in 1994.

There were a number of passengers inside Blevins’ car. These passengers included children. None of the passengers were injured.

One of the Minnesota State Troopers was injured because he was inside of his squad car at the time of the accident. His injuries were not severe. The trooper, Allen Thill, said that the possibility of an accident is always on his mind, but he never expected to be rear-ended while in his cruiser.

When Blevins was observed by troopers, it was found that he had watery and bloodshot eyes, he smelled like alcohol, and his speech was slurred. A blood test would later be conducted that showed his blood alcohol concentration to be 0.166 percent, which is twice than the legal limit of .08.

The following Monday, Blevins was released from Hennepin County Jail after he posted bail of $12,000.

Safety Tips for Motorcycles

Motorcycles are a great way to feel connected to the act of driving and to the surrounding landscape. While motorcycles are a great source of fun and a convenient mode of transportation, there are a number of dangers associated with motorcycle riding that can result in serious traffic accidents and injuries.

As such, it is important for both motorcycle riders and the drivers of other vehicles on the road to be aware of some of the dangers associated with motorcycles to prevent accidents from occurring.

Motorcyclists should invest in quality materials to keep themselves safe. Primarily, this means a sturdy and well-fitting helmet, as well as a thick leather jacket. This jacket will not only look good, but will keep the rider’s arms and torso safe in the event of an accident.

Both motorcyclists and other drivers alike should drive in a courteous manner and be willing to share the road. When drivers get aggressive on the road, accidents are more likely to occur. All drivers should be willing to let other drivers pass them and change lanes when necessary, regardless of the vehicle they are driving.

Motorcyclists should wear bright clothing to increase visibility. Sometimes, the size of motorcycles makes it difficult for motorcyclists to be seen by drivers of larger automobiles. Bright colors will help increase visibility on the road.

Dangerous driving practices like tailgating and weaving should be avoided at all times.

Factors in Garbage Truck Collisions

Waste management is an arduous but necessary part of every major city’s basic services; the cities of Minnesota are no exception. Unfortunately, garbage trucks, like other large motor vehicles, are capable of causing serious accidents if negligently driven or handled.

Although any powerful motor vehicle can cause severe injury in the event of an accident, the ways in which garbage trucks are typically operated create several unique safety concerns for nearby drivers and pedestrians.

  • Narrow roads and alleyways: Because garbage collection trucks must navigate through a complex network of city streets and back streets, they often find themselves in narrow alleyways where visibility and maneuverability are limited. If a driver fails to take proper precautions, an accident is likely.
  • Erratic driving patterns: Garbage trucks make frequent and often unexpected stops to pick up waste. Drivers and cyclists around the truck may be in danger if these stops are made too quickly or without warning.
  • Falling objects/waste: The many waste items and objects that a garbage truck may be carrying at any time are also hazards. If they are negligently piled up or inadequately secured, they may fall from the truck onto nearby cars or pedestrians – a serious danger if the garbage truck is moving at a high speed.
  • Mechanical failure: In addition to tire defects, brake system malfunctions, and other dangerous mechanical failures, garbage trucks are also vulnerable to breakdowns of their unique moving parts, including compartment doors and lifting arms.

Speeding Accident Lawsuits

Do you have questions about the circumstances of an accident that was not your fault? An accident that was made worse by excessive speed? We can help.

Speeding is negligence because drivers have a duty to obey traffic laws. Speeding is one of the main causes of vehicle-related accidents.

If you have been injured in a speeding-related car accident that was not your fault, contact a Minneapolis car accident lawyer at (612) TSR-TIME. We will go to work on your case, fighting for just compensation and ensuring that your rights are protected. Our lawyers are aggressive, ethical litigators with years of experience.

Speeding Accident Statistics

Speeding greatly increases the chance of being involved in an accident because driver reaction time is drastically reduced, vehicles may perform differently at high speeds, and the law of physics tells us that the harder you hit something, the more severe the resulting damage and injury.

In 2009, speed contributed to 28% of Minnesota’s fatal accidents. It is written into Minnesota state law that drivers are to use duty of care when operating a vehicle; which includes obeying the speed limit. Statistics compiled by the NHTSA show that speeding among drivers involved in alcohol-related crashes is also common.

The Minnesota State Statute dealing with duty of care and speed limits is 169.14. It is as follows:

Subdivision 1. Duty to Drive with Due Care

No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions. Every driver is responsible for becoming and remaining aware of the actual and potential hazards then existing on the highway and must use due care in operating a vehicle. In every event speed shall be so restricted as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care.

In a car accident where the offender was using excessive speed, the victim may be able to obtain compensation for:

  • medical expenses;
  • lost wages;
  • pain and suffering; and/or
  • other applicable damages.

Man Charged in Fatal Truck Crash that Killed MN Man

A former semi truck driver has been charged in the death of a fellow truck driver in a semi truck crash that occurred on Interstate 94. He is scheduled to stand trial from May 22 to the 24th.

Great Lakes, Illinois resident Destry D. Wilson, 23, is charged with felony homicide for allegedly being negligent and intoxicated at the time of the accident. He is also charged with the misdemeanor possession of drug paraphernalia. He was also cited for operating while intoxicated and operating a motor vehicle with a restricted controlled substance in his possession.

After the fiery crash that killed 43-year-old Brian L. Paglusch, Wilson told authorities that he had smoked some synthetic marijuana. He did test negative for illegal substances, though. According to the criminal complaint, a pipe was found in the semi with Wilson after the accident.

During an August preliminary hearing, a Menomonie police officer testified that on July 31 at 11:15 p.m., he had arrived on the scene of the crash where he found two semi trucks blocking the westbound lanes at the 42 mile marker, just past a rest area in Menomonie.

The officer observed Paglusch’s truck completely up in flames after he had rear-ended the flatbed truck that was driven by Wilson. The flatbed was stopped in the right westbound lane. Paglusch was pronounced dead at the scene because he was not able to get out of the truck.

Wilson would tell police, according to reports, that he had left the rest stop and was moving at highway speed. However, a number of witnesses told authorities that Wilson’s truck was not moving at all. A reconstructionist and a State Patrol officer testified that it appeared that Paglusch had slammed on his brakes in order to not hit Wilson’s truck.

A motion hearing is scheduled for April 5 and the final pretrial is slated for May 5.
