What Counts as Wrongful Death in Minnesota?
Under Minnesota Statutes §573.02, a wrongful death occurs when someone’s life is taken because another person – or entity – acted negligently or wrongfully. Families can pursue a claim when preventable negligence leads to fatal injuries, including:
Motor vehicle crashes
Deadly collisions caused by speeding, distracted driving, drunk driving, failure to yield, unsafe passing, and especially crashes involving commercial trucks.
Slip and fall incidents
Fatal falls caused by wet floors, uneven surfaces, broken railings, unsafe stairs, or property owners who fail to correct or warn about dangerous conditions.
Workplace or industrial accidents
Construction and manufacturing workers are exposed to heavy machinery, heights, defective equipment, electrical hazards, and other risks that can lead to fatal injuries.
Motorcycle crashes
Lane-change collisions, tailgating, left-turn accidents, and road hazards often cause life-ending trauma to motorcyclists.
Medical malpractice
Misdiagnosis, delayed treatment, surgical errors, medication mistakes, or failure to follow proper procedures can lead to preventable death.
If you believe your loved one’s death could have been avoided, TSR can evaluate whether negligence is present and explain the legal path available to your family.
